1. Acceptance of Terms

By accessing or using the Ascent application, website, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Ascent Health (“Ascent”, “we”, “us”).

2. Description of Service

Ascent is an AI-powered health tracking platform that provides nutrition tracking, barcode scanning, intermittent fasting protocols, water quality analysis, wearable integrations, and personalized health insights. The Service is currently in beta and subject to change.

3. Eligibility

You must be at least 16 years old to use the Service. By using Ascent, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

5. Health Disclaimer

Ascent is not a medical device and does not provide medical advice. The information provided by the Service, including AI-generated insights, nutrition data, and health scores, is for general informational and educational purposes only.

• Always consult a qualified healthcare provider before making changes to your diet, exercise, or health routine.
• Do not disregard professional medical advice based on information from Ascent.
• If you have a medical emergency, contact emergency services immediately.
• AI-generated recommendations may not account for your specific medical conditions, medications, or allergies.

6. User Data & Privacy

You retain ownership of all data you submit to the Service. We process your data in accordance with our Privacy Policy, which forms part of these Terms.

• You may export your data at any time in JSON or CSV format.
• You may request complete deletion of your account and data at any time.
• We will never sell your personal or health data to third parties.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Reverse engineer, decompile, or disassemble the application
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use bots, scrapers, or automated tools to access the Service excessively
• Distribute malware or harmful code through the Service
• Harass, abuse, or harm other users
• Circumvent rate limits, security measures, or access controls
• Use the AI chat for purposes unrelated to health and wellness

8. Intellectual Property

All content, features, functionality, trademarks, and intellectual property of the Service are owned by Ascent Health and protected by international copyright, trademark, and other IP laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

9. Third-Party Integrations

The Service may integrate with third-party platforms (Apple Health, Whoop, Garmin, Oura). Your use of these integrations is subject to the respective third party's terms and privacy policies. Ascent is not responsible for third-party services.

10. Beta Service

The Service is currently in beta. This means:

• Features may change, be added, or be removed without notice.
• The Service may experience downtime or bugs.
• Data accuracy is provided on a best-effort basis.
• Pricing and plans have not been finalized.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ascent Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, profits, or goodwill, resulting from:

• Your use of or inability to use the Service
• Any inaccuracies in nutrition data, AI recommendations, or health insights
• Unauthorized access to your account or data
• Any third-party integrations or services

12. Indemnification

You agree to indemnify and hold harmless Ascent Health and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of Spain. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to your rights under mandatory consumer protection laws of your country of residence.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately, but your data rights under our Privacy Policy remain intact.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.
